Online Science Classes – Terms and Conditions

IMPORTANT, READ CAREFULLY: YOUR USE OF AND ACCESS TO PRODUCTS AND SERVICES OF FIZZICS EDUCATION PTY LTD IS CONDITIONED UPON YOUR COMPLIANCE WITH AND ACCEPTANCE OF THESE TERMS, WHICH INCLUDE YOUR AGREEMENT TO ARBITRATE CLAIMS. PLEASE REVIEW THOROUGHLY BEFORE ACCEPTING.

Definitions

  • “You” refers to the individual registering for the session.
  • “Participant” refers to any child or adult intending to participate in the video conferencing session.
  • “Misconduct” includes, but is not necessarily limited to, behaviour that is deemed inappropriate due to its potentially harmful, dangerous, illicit, violent, emotionally distressing, bullying, or abusive nature.
  • “Warning” may be issued verbally by the presenter, or via a text-based function such as chat.

Use of services and your responsibilities

Different web conferencing platforms have different features and abilities to control online child safety. We have strong controls around online child safety and as such will choose either Zoom Meeting or Zoom Webinar as the preferred solution, depending on the number of participants and the situation.

  • You understand and acknowledge that during a Zoom Meeting the participant(s) will be visible and audible to our presenter and other participants.
    It is possible to turn audio and video on and off at the participant’s own discretion, although participant interactions will be greatly reduced when audio or video or both are turned off. You understand that as a supervising adult, you are responsible for the protection of the participant’s identity through either muting their video or audio settings and for ensuring that participant’s last name, phone number, home address or any other personally identifiable information is not broadcast publicly. Please contact Fizzics Education if you are unsure of the format being used.

  • You understand and acknowledge that during a Zoom Webinar, participants are never visible or audible to our presenter and other participants.
    Interaction will be via Q & A or via polling. Please contact Fizzics Education if you are unsure of the format being used.

You acknowledge that the Fizzics Education presenter is not a substitute for on-site parental supervision. As a supervising adult, you acknowledge that you are responsible for the supervision of the participants for their behaviour.

You understand and acknowledge that Fizzics Education presenters have the authority to take action when dealing with participant misconduct. A warning will be issued for the initial offense, followed by disabling the offending participant’s audio or video input, or both. At this stage, the offending participant will still be able to receive audio and video of the session. If any misconduct persists, the presenter will remove the offending participant from the video conferencing session and where applicable, the parent or guardian of the participants will be notified.

If anything serious is posted or spoken by any participant, Fizzics Education reserves the right to remove that child and work with relevant authorities on a case by case basis.

The session will be delivered via Zoom Meeting or Zoom Webinar, both high-performance video conferencing platforms. You may wish to refer to Zoom’s terms and conditions. You will need a reliable internet connection, with a minimum speed of 1Mpbs for both upload and download. Fizzics Education is not responsible for any deficiencies in service delivery directly caused by Zoom, Zoho or your internet service provider.

Should a third-party organisation invite us into a web conferencing platform other than those listed above

“You” refers to the individual booking the session.

  • You understand and acknowledge that it is the responsibility of the supervising teacher or adult to ensure that cyber safety measures are in place, in line with our Online Child Protection Policy. This may include, but is not limited to, enabling privacy and security settings within the chosen platform to prevent uninvited connections, inappropriate media being shared, or personal information being shown.

  • You are responsible for setting up the virtual video conferencing room to the requirement of the workshop or show (e.g. correct capacity to accommodate all participating parties). You are also responsible for providing Fizzics Education with the associated links and giving appropriate permissions and access to the virtual rooms for our presenter(s).

  • The supervising teacher or adult is responsible for participant management including, but not limited to, turning participant’s audio/video input on or off and monitoring behaviour in communications between participants. The supervising teacher or adult is also responsible for troubleshooting technological issues relating to the chosen platform for presenters and/or participants.

In the event that your chosen platform does not have the capability to meet the requirements as described above:

  1. You accept that any objectionable event including, but not limited to, security breaches and violations of the Enhancing Online Safety for Children Act 2015, that occurs in the session as a result of using the chosen platform is your responsibility.

  2. You accept that Fizzics Education may have to alter the programme offered from what was advertised in order to cater to the chosen platform. This may be for cybersecurity, participant engagement or technological reasons.

  3. Fizzics Education is not responsible for any deficiencies in service delivery directly caused by your chosen platform.
